§ 35.12.01 MONUMENT, LOT DECORATIONS AND DESIGNATED LANDSCAPE AREA.
   (A)   Each burial site on which an authorized above-ground monument has been placed pursuant to § 35.12 shall be allowed an additional area, referred to herein as the "designated landscape area" for placement of appropriate decorations and mementos.
   (B)   The "designated landscape area" shall extend out into the lot from the face of the above-ground monument for a maximum depth of twelve (12) inches and shall be no wider than the monument itself.
   (C)   The "designated landscape area" shall be enclosed by a border or edging which shall not be placed or extend beyond the maximum dimensions provided for the designated landscape area. The border or edging shall have a minimum above-ground height of two (2) inches. Plastic border or edging not specifically authorized hereby is prohibited.
   (D)   No object or item of any nature shall be allowed within a "designated landscape area" that is considered to be offensive to the general public; that impedes proper maintenance of the cemetery; that poses a threat to the safety of visitors or detracts from the dignity and general character of the cemetery. Such inappropriate items will be immediately removed by the sexton or the designee of the sexton without additional notice other than that provided by this section. All items so removed will be stored by the sexton for thirty (30) days, and if not retrieved by the cemetery patron within that time, will be disposed of by the city.
      (1)   Objects and items of personal or symbolic importance shall be allowed within a "designated landscape area" but are subject to the restrictions and regulations set forth in this chapter.
      (2)   Living plants, flowers or shrubs may be planted within a "designated landscape area." Any such planting which grows or spreads beyond the boundary of the designated landscape area, or reaches a height greater than the height of the monument or three (3) feet, whichever is less, shall be trimmed or removed by either the cemetery patron or by the sexton or the designee of the sexton. Trees or other similar planting which ordinarily grow to a height greater than the height of the monument, or three (3) feet, whichever is less, are prohibited.
      (3)   (a)   Shepherd's Hooks or similar items may not be placed in the "designated landscape area." A maximum of one (1) black metal Shepherd's Hook may be placed at either end of any above-ground monument authorized by this chapter and shall abut the above-ground monument as closely as possible. Shepherd's Hooks may only be used for the display of a hanging flower basket or wreath. No other item of any sort may be affixed to, or hung upon any Shepherd's Hook being utilized for an unauthorized purpose, or that is un-used, or that has become rusty, unsightly, or has fallen in to disrepair shall be immediately removed by the cemetery patron and may be removed by the sexton or the designee of the sexton.
         (b)   Two (2) Shepherd's Hooks are allowed in circumstances where an above-ground monument marks burial sites on both sides of the monument. In such circumstances, the two (2) Shepherd's Hooks shall be placed on opposite ends of the monument.
      (4)   Solar lights shall only be allowed within the "designated landscape area" of a burial site. A maximum of two (2) non-flashing white solar lights may be places on any "designated landscape area" or may be mounted on or affixed to any above-ground monument. Any solar light which is deemed by the sexton or the sexton's designee to be excessively bright or inappropriate for any reason shall be removed.
