§ 35.12 MONUMENTS.
   (A)   Monuments shall be of bronze or marble, granite or other durable stone approved in advance by the sexton or his or her designee.
   (B)   Every burial site or lot wherein the right of burial has been exercised shall be marked by either an above-ground monument or by a monument set flush with the ground. There shall be no more than one (1) above-ground monument per lot and no more than one (1) additional monument flush with the ground.
   (C)   No monument shall be placed on any lot without the advance approval of the sexton or his designee, who may withhold approval for any monument which would pose an undue maintenance problem, endanger the safety of visitors or be out-of-keeping with the general character of the cemetery. If the right to place any monument is denied by the sexton, or his designee, the decision may be appealed to the Mayor whose decision shall be final.
   (D)   All monuments shall be located on the lot and placed on appropriate foundations as shall be determined and installed by the sexton. The fee for installing a foundation shall be one hundred and five dollars ($105.00) per square cubic foot of the foundation as measured at its largest area. All additional installation costs shall be the sole responsibility of the owner.
   (E)   No monument shall be installed on any lot for which the fees for right of burial are then owing to the city for that lot or other lots owned by the same person or persons.
   (F)   The city shall not be responsible for any loss or damage to any monument not directly caused by city employees.
   (G)   No permanent articles other than approved monuments may be placed on any lot sold, except as specifically authorized in division (I) or within the "designated landscape area" described in § 35.12.01.
   (H)   To facilitate mowing and trimming, decorations may only be placed upon above-ground monuments or within the "designated landscape area" described in § 35.12.01. Natural decorations will be removed when wilted. Any decorations, in any location, which at any time impede proper maintenance, pose a threat to the safety of visitors or detract from the general character of the cemetery will be removed and disposed of by the sexton.
   (I)   Benches made of bronze or marble or other durable stone may be installed with a proper foundation at the foot of the grave site, in lieu of the flush mounted monument described in division (B), above. No bench shall be wider that than the width on one (1) individual lot and no bench shall have a depth of greater than eighteen (18) inches. All benches must be approved in advance by the sexton or his or her designee. The sexton, or his or her designee, shall not grant permission to install any bench which impedes proper maintenance, poses a threat to the safety of visitors or detracts from the general character, of the cemetery. The cemetery reserves the right to remove and dispose of any bench which has been installed without the specific authorization of the sexton or his or her designee, or which does not comply with the authorization granted by the sexton or his or her designee.
