§ 110.02 DEFINITIONS.
   For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   “FISCAL YEAR.” July 1st of any year through June 31 of the next following year.
   “PERSON.” Any individual, partnership, corporations, or legal entity which is or may be authorized by law to conduct business activity.

§ 110.03 BUSINESS LICENSE REQUIREMENT AND FEES IMPOSED ON THOSE ENGAGED IN ANY BUSINESS.
   (A)   All persons, partnerships and corporations which are engaging in a trade or business within the incorporated boundaries of the City of Lawrenceburg shall annually purchase a City of Lawrenceburg Business License which shall be prominently displayed at their local place of business. The amount of the business license fee, shall be based upon the maximum number of employees (including the owner) working within the City limits, on any given day during the license period, as follows:
      (1)   One employee         $65.00;
      (2)   Two to five employees   $200.00;
      (3)   Six to 25 employees      $400.00;
      (4)   26 to 100 employees      $700.00; and
      (5)   101 employees or more   $1,000.00.
   (B)   For the purpose of this section, the sole owner or proprietor of a business shall be considered an employee. Farmers and farm laborers shall not be considered employees for the purpose of this section.
   (C)   Failure to procure proper license herein on or before July 1 of each year shall result in an administrative penalty of a $25 late fee.
   (D)   No business license as prescribed herein shall be issued to any applicant who has failed to purchase an otherwise required business license for any of the three years prior to the year for which an application is submitted.

§ 110.04 APPLICATION AND ADMINISTRATION.
   (A)   Every person, firm or corporation required to purchase a license under § 110.03 shall submit an application for such license to the Lawrenceburg City Clerk. The application shall be a written statement upon forms provided by the City Clerk. The application shall require the disclosure of all information necessary for compliance with the provisions of this chapter, and of any other information which the City Clerk shall find to be reasonably necessary to the fair administration of this chapter.
   (B)   The annual business license fee imposed under § 110.03 hereof shall be due and payable to the city on or before July 1st of each year.
   (C)   Proration. The license fee for any business license issued for a fractional part of any year shall be prorated based on the quarters remaining in the year. A portion of a quarter shall be considered an entire quarter for purposes of proration and in no event shall a license be issued for less that 50% of the annual fee set forth herein.

§ 110.05 INTERIM BUSINESS LICENSE.
   Any person, firm or corporation doing business within the incorporated boundaries of the city on a one-time basis may be allowed to purchase an interim business license as opposed to an annual business license. The interim business license shall be good for 72 hours. The cost shall be $25 and payable to the Lawrenceburg City Clerk under the same licensing requirements contained herein. In no instance may a person, firm or corporation qualify for the issuance of an interim business license more than two times per year.

§ 110.06 APPLICATION.
   Notwithstanding the foregoing, the provisions of this chapter shall not apply to:
   (A)   Sales at wholesale to retail merchants by commercial selling agents in the usual course of business.
   (B)   Wholesale trade shows or conventions.
   (C)   Sales of goods, wares or merchandise by sample catalogue or brochure for future delivery.
   (D)   The sponsor of any general sale, fair, auction or bazaar sponsored by any religious, educational, public service or charitable organization.
   (E)   Garage/yard sales held on premises devoted to residential use or held in accordance with a recognized state wide tourism event, i.e., 127 yard sales.
   (F)   Sales of crafts or items made by hand and sold or offered for sale by the person making such crafts or handmade items.
   (G)   Sales of locally grown agricultural products.
   (H)   Sales made by a seller at residential premises pursuant to an invitation issued by the owner or legal occupant of such premises.
   (I)   Sheriffs, constables or other public or court officers, or any other person or persons acting under the direction or authority of any court, state or federal, selling goods, wares or merchandise in the course of their official duties.
   (J)   Flea market vendors who can demonstrate compliance with KRS 139.550.

§ 110.07 MISCELLANEOUS PROVISIONS.
   (A)   The provisions of this chapter are severable, and if any provision, section, paragraph, sentence or part thereof, or the application thereof to any person, license, class or group, be held unconstitutional or invalid for any reason, such holding shall not effect or impair the remainder of this chapter; it being the legislative intent of the City Council to ordain and enact each provision, section, paragraph, sentence and part thereof, separately and independently of every other.
   (B)   The provisions of this chapter shall become effective immediately upon approval, publication and attestation as required by law.

§ 110.99 PENALTIES.
   Any person engaging in a trade or business within the incorporated boundaries of the City of Lawrenceburg without having procured the license required by §§ 110.03 or 110.05 shall be guilty of a violation as defined in KRS 500.080.
