§ 5-2-6-55. BURIED MATERIALS.
   (A)   At the discretion of the City Civil Engineer, non-polluting construction materials (such as brick, stone and/or wood scrap) or natural debris may be buried in the ground outside the right-of-way lines and lot lines, building structure foundation areas and storm water facility installation areas, provided:
      (1)   Material placement will clearly not interfere with the stability of fill areas;
      (2)   Material used for fill or grading can be properly compacted in order to avoid future settlement of fill areas or structures/facilities erected over such fill;
      (3)   No material is placed which due to its size or character would prevent proper compaction or would cause later settlement of the ground surface; and
      (4)   Buried material pit areas or locations are clearly delineated on the record drawings required in accordance with regulations promulgated under § 5-2-6-37 and, if applicable, the recorded plat.
   (B)   Burial of materials shall, where applicable, be accomplished in conformance with the requirements of Title 2, Article 1 and Title 5, Article 2 of the Lawrence Municipal Code and Chapter 12 of the Code of The Health and Hospital Corporation of Marion County, Indiana.
