§ 3-2-7-4. NOISE LIMITS.
   (A)   No person shall operate a motor vehicle of a type subject to registration at any time, or under any condition of grade, load, acceleration or deceleration on a public street or highway in a manner as to exceed the following noise limit measured in decibels on the A scale for the category of motor vehicle at the distance specified. The measurement shall be made at least 50 feet from the center of the lane of travel.
      (1)   Any motor vehicle with a manufacturer’s gross vehicle weight rating of 7,000 pounds or more:
         (a)   88 dB(A) for vehicles traveling 35 mph or less; or
         (b)   90 dB(A) for vehicles traveling over 35 mph.
      (2)   Any motorcycle or other motor driven cycle:
         (a)   82 dB(A) for vehicles traveling 35 mph or less; or
         (b)   86 dB(A) for vehicles traveling over 35 mph.
      (3)   Any other motor vehicle:
         (a)   76 dB(A) if traveling 35 mph or less; or
         (b)   82 dB(A) if traveling over 35 mph.
   (B)   The noise limits apply to the total noise from a motor vehicle, including other vehicles attached thereto.
   (C)   If the manufacturer’s gross vehicle weight cannot be readily ascertained, it shall be presumed to be 7,000 pounds if the unladen weight is 6,000 or more pounds and shall be presumed to be less than 7,000 pounds if the unladen weight is less than 6,000 pounds.
   (D)   It is unlawful to operate any automobile, motorcycle or other kind of vehicle so out of repair, or so loaded, or in a manner so as to create loud and unnecessary grating, grinding, rattling or other noise.
