§ 1-1-3-12. DEPARTMENT OF PUBLIC WORKS.
   (A)   A Department of Public Works is hereby established which shall be administered by the Board of Public Works and Safety, pursuant to I.C. 8-1.5-3 and 36-9-6, and shall be headed by the Mayor.
   (B)   Four divisions are hereby established within the Department of Public Works, as follows.
      (1)   A Division of Streets and Drainage is hereby established which shall be headed by the Street Commissioner. The Division shall be responsible for the construction and maintenance of all public streets, alleys, sidewalks, storm sewers and other watercourses, pursuant to I.C. 36-9-6.
      (2)   A Division of Public Buildings and Property is hereby established to be headed by the Building Commissioner. The Division shall be responsible for the custody, maintenance, improvement and construction of all City property, pursuant to I.C. 36-9-6-3.
      (3)   A Division of Sanitation is hereby established which shall be headed by the Director of Sanitation. The Division shall be responsible for providing and maintaining a residential refuse collection service for the City.
      (4)   A Division of Municipal Utilities.
   (C)   The City Civil Engineer appointed pursuant to I.C. 36-4-9-8 also shall be a part of and render engineering services to the Department of Public Works and other officials, departments and divisions of the City.
   (D)   All personnel of the divisions listed in division (B) above shall be included within the Department of Public Works.
   (E)   The Department of Public Works shall be responsible for carrying out the powers and duties prescribed by I.C. 8-1.5-3, 32-16-1 et seq., 36-8-3, 36-9-6, 36-9-23 and 36-9-28 and all other powers and duties prescribed by statute for public works boards.
