10-3-2: DEFINITIONS:
For the purpose of this chapter the following terms, phrases, words, and their derivations shall have the meaning given herein. When not inconsistent with the context words in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
ASHES: The residue from burning of wood, coal, coke or other combustible material.
CITY: The City of Lava Hot Springs.
COLLECTOR: The City of Lava Hot Springs or the person holding a contract issued or granted by the City authorizing such person to operate, conduct and maintain a Municipal garbage and refuse collection and disposal system upon, on and over streets, alleys and public ways of City.
GARBAGE: Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.
OWNER AND OCCUPANT: Every "person" as herein defined in possession, charge, custody or control of any premises where garbage, refuse and rubbish is created or accumulated.
PERSON: Any person, firm, partnership, association, corporation, company or organization of any kind.
PREMISES: Land and all dwellings and structures thereon including, but not excluding, by enumeration, single- or multi-family dwellings, rooming houses, apartment houses, hospitals, convalescent and nursing homes, hotels, and motels, restaurants, drive-in establishments or place of conducting business, trade or occupation.
REFUSE: All putrescible and nonputrescible solid waste (except body waste) including garbage, rubbish, ashes, street cleanings, small dead animals and solid market and industrial wastes.
RUBBISH: Nonputrescible solid waste (excluding ashes) consisting of both combustible and noncombustible waste, such as paper, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery, and similar materials.
SANITARY CONTAINERS: Approved sanitary containers or receptacles of not less than twenty (20) gallon capacity, not more than thirty two (32) gallon capacity or as provided in subsection 10-3-9A of this chapter and may be any of the following:
   A.   Disposable (nonreturnable) paper sacks, which shall be fifty (50) pound wet strength extensible kraft paper.
   B.   Disposable (nonreturnable) plastic bags, which shall be manufactured from polyethylene copolymer resin, with the gauge of not less than 1.5 mils.
   C.   Metal or plastic cans which must not have any inside structures to prevent the free discharge of the contents.
   D.   The aforesaid paper sacks or plastic bags may be used as liners in cans, but such sacks or bags used as liners shall be watertight, of a solid and durable material and shall be equipped with a suitable close fitting cover.
   E.   Approved mechanical dumping containers of one yard or more capacity.
TRASH: Nonputrescible solid waste such as excelsior, rags, wooden boxes or cardboard or paper boxes, bottles, broken ware, small metal scraps, small mechanical parts, shavings, floor sweepings excluding dirt floors, and all other things of similar nature. The term "trash" as used in this chapter shall not include debris resulting from construction, reconstruction or repairs of premises, automobile frames, fallen trees, large tree limbs, nor other waste matter that is not properly contained as specified in this chapter.
