§ 151.22 PROCEDURES FOR CUTTING OR EXCAVATING.
   (A)   It shall be unlawful for anyone to cut or excavate or to cause cutting or excavating on the right-of-way of any public street in the town without complying with all of the following conditions.
      (1)   Safety precautions.
         (a)   All normal and reasonable safety precautions including placement of signs, cones, warning lights and barricades around all openings must be observed.
         (b)   All utility lines, pipes and the like shall be buried to a depth not less than 18 inches.
      (2)   Restoration of site.
         (a)   The backfill around and under pipes and other utility installations on all open cut sections across or parallel to roads shall be made of approved material, free from rocks, in six-inch loose layers and shall be compacted sufficiently to prevent settling. When compacting in layers, each layer must be thoroughly tamped by a mechanical tamp before the next layer is put in place. A pneumatic tamp, a gasoline ram type tamp or a vibrating tamp will be required in order to meet the specifications of “mechanical tamp”.
         (b)   All storm water drain paths existing prior to the cutting or excavating must be re-established unless an improved drainage system, agreed to in advance by the town is established.
         (c)   All restoration shall include the ditch, shoulder or berm area and shall include the re-seeding of all grass areas within the right-of-way which have been disturbed by the cutting or excavating.
         (d)   All debris resulting from the cutting or excavating must be removed.
         (e)   All workmen and supervisory persons shall at all times treat town residents with courtesy and shall cause as little disruption to normal traffic flow as is feasible.
   (B)   If, for any reason, the operation will require more than three days to complete, the town office must be so advised.
