(A) It shall be unlawful for anyone, other than employees of the town in the course of their prescribed duties, to create or cause to be created any excavation on the public right-of-way or to cut or cause any cutting of the surface of any public street within the town for the purpose of installing, repairing or making connection with water lines, sewer lines, gas lines, telephone lines, power lines, cable lines or for any other purpose without having first obtained a permit to do so from the town and without being in conformance with the procedures and methods set forth in this subchapter. Application is to be made a minimum of two working days prior to the actual work start date.
(B) The applicant shall also notify the state’s One-Call Center to verify locations of utilities within the defined work area.
(C) (1) Prior written permission will not be required when emergency repairs are necessary to restore essential services needed to protect public health, safety and welfare.
(2) However, the town shall be informed of the work in progress as soon as practicable.
(3) Emergency repairs shall be further described as repairs which become necessary because of damage to a utility facility caused by accidents, storms, weather disturbances or other unforeseeable events or because there is a hazard to public safety.
