§ 90.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   The Valley Hill Fire and Rescue Department Fire Chief or his or her approved designee shall cause extinguishment of all open burning that violates §§ 90.30 through 90.33. The Henderson County Fire Marshal or the Town of Laurel Park Police Chief and their approved designees may issue a citation in the amount of $100 per incident. Violation of §§ 90.30 through 90.33 shall constitute a misdemeanor punishable in accordance with G.S. § 14-4. In addition to any citation/penalty, the violator may be assessed the cost of extinguishing the fire by the town. These costs are to be calculated using the fees set out in the town's schedule of fees as adopted by the Town Council and on file in the office of the Town Clerk.
   (C)   Any violation of the provisions of §§ 90.45 through 90.47 of this chapter shall constitute a Class 3 misdemeanor punishable, upon conviction, as provided in G.S. §§ 14-4 and 160A-175. The penalty for such violation shall subject the violator to a fine of not less than $50 and not more than $500, or as amended.
