§ 90.47 ENUMERATION OF PROHIBITED NOISES.
   (A)   The following acts are declared to be loud, disturbing and unnecessary noises in violation of this subchapter.
   (B)   This is not an inclusive list:
      (1)   Sounding of any horn or signal device on any automobile, motorcycle, bus or other vehicle while not in motion (except as a security alarm or a warning if another vehicle is approaching apparently out of control) or, if in motion, only as a danger signal after or as brakes are being applied and deceleration of the vehicle is intended;
      (2)   Using any automobile, motorcycle or other vehicle in such a manner as to create loud or unnecessary grating, grinding, rattling or other noise;
      (3)   Discharging the exhaust of any motor vehicle, gasoline engine or motor boat engine, except through a muffler or other device which will effectively prevent loud or explosive noises;
      (4)   Using any gong, siren or similar device upon any vehicle, other than police, fire or other emergency vehicle;
      (5)   Playing of any television, radio, musical instrument or similar device with such volume as to annoy or disturb the quiet, comfort or repose of any person(s) in any type of residence, particularly between 10:00 p.m. and 7:00 a.m.;
      (6)   Keeping any animal or bird which disturbs the comfort and repose of any person(s) in the vicinity by causing frequent or long continued noise;
      (7)   Using any mechanical device operated by compressed air unless the noise created is effectively muffled and reduced;
      (8)   The erection (including excavation), demolition, alteration, or repair of any building other than between the hours of 7:00 a.m. and 6:00 p.m., Monday through Saturday, unless necessary in the interest of public safety. Activities listed are also prohibited on Thanksgiving Day and Christmas Day;
      (9)   Creating any excessive noise on any street adjacent to any education, religious or judicial building while in session, or within 150 feet of any medical facility;
      (10)   Creating loud and/or excessive noise while loading or unloading any vehicle or while opening or destroying bales, boxes, crates and other containers;
      (11)   Sounding any bell, gong or similar device attached to any building which disturbs the quiet or repose of any person(s) in the vicinity;
      (12)   Using any drum, loudspeaker or other similar devices for attracting attention to any performance, sale or display of merchandise;
      (13)   Using mechanical loudspeakers or amplifiers on trucks or other moving vehicles for any purpose;
      (14)   Conducting, operating or maintaining of any business so as to cause loud or offensive noises to be emitted between 10:00 p.m. and 7:00 a.m.;
      (15)   Firing or discharging a firearm, squibs, firecrackers, gunpowder or other combustible substances in the streets or elsewhere for the purpose of making noise or a disturbance; and
      (16)   The use of compression brakes (sometimes referred to as “Jake brakes”) by any vehicle so equipped to downshift and release the clutch to slow the vehicle’s engine, except in case of emergency. The burden in each case shall be upon the vehicle operator to establish the existence of the emergency.
