§ 129B.05  OPERATION OF PEDICAB BUSINESSES.
   Pedicab businesses shall be operated only with the additional regulations given in this section.
   (A)   A copy of the pedicab license shall be displayed on all pedicabs used in such business. The City Clerk, upon issuance of the license, shall issue that number of duplicates as requested in the application identifying each pedicab identified in the application.
   (B)   Each pedicab used in such business shall have a valid pedicab license issued pursuant to this chapter.
   (C)   Each pedicab shall be operated by the holder of a valid driver’s license, who shall have such license on his or her person at all times when operating such vehicle.
   (D)   When carrying persons for hire or by contract, the vehicle shall be operated only in the approved area of operations.
   (E)   No pedicab vehicle shall be operated on a public street unless a valid liability insurance policy as specified in this chapter is on file with the City Clerk.
   (F)   It shall be the duty of the driver of the pedicab to inform any person hiring the carriage of all the rates and charges before any service is rendered, which shall be the same as those on file with the City Clerk.
   (G)   Drivers shall carry rate cards and exhibit them on demand.
   (H)   Occupancy of the pedicab shall not exceed the rated seating capacity of the vehicle, which in most cases will be two adults, and one child.
   (I)   No passenger shall be allowed to ride on any part of the vehicle when in motion except seated inside the vehicle.
   (J)   Drivers are prohibited from smoking while carrying passengers.
   (K)   No person may drink any alcoholic liquor while such person is operating a pedicab.
   (L)   Additionally, each pedicab business application shall include the names and following information regarding any potential driver, all of which drivers shall have the following indicated classifications:
      (1)   Possesses a valid, current operator’s license issued by the state.
      (2)   Is at least 18 years of age.
      (3)   Is free of defective vision, defective hearing, and any other infirmities that would render him or her unfit for safe operation of a public vehicle.
      (4)   Is free of alcohol or drug addiction.
      (5)   Has not, within the ten years immediately preceding his or her application, been convicted of any felony, or operating a motor vehicle while under the influence of alcohol or a drug.
      (6)   Has not received more than three moving traffic violations in the immediately preceding 12 months or five moving traffic violations in the immediately preceding 24 months of application.
      (7)   Is not otherwise deemed in the appropriate exercise of discretion by the City Council of the City of LaSalle as an appropriate candidate for a pedicab license.
      (8)   Has delivered to the City Clerk a certificate signed by the pedicab licensee or other sufficient evidence that such person is qualified to operate a pedicab.
      (9)   Has complied with the provisions of §§ 129B.03(A)(3) and (A)(4) above.
