Each lot owner who constructs or has constructed on any lot in a subdivision shall provide, or shall make certain that the contractor or any other person building the home provides, erosion control on the lot during the construction period and thereafter, so that sand, soil, or any other material or debris from the lot does not wash or flow, and is not carried or moved in any manner into or onto the following:
(A) Other lots in the subdivision;
(B) Any other properties in the area;
(C) Any public streets or roadways; or
(D) Any wetland areas, including lakes, ponds, rivers, creeks, or ditches, not specifically designed as a retention area for that subdivision.
