§ 71.99  PENALTY.
   (A)   (1)   These penalty provisions apply to any vehicle that violates the weight restriction provided in §§ 71.01, 71.03, and Chapter 74, Schedule I.
      (2)   (a)   Any person causing to operate or operating a vehicle or a combination of vehicles on a county road with weight and excess provided by ordinance may be detained until the weight or combination vehicle is reduced or distributed to comply with the limitations provided by ordinance.
         (b)   If such vehicle is unable to have the weight distributed or reduced, such vehicle may be impounded and the costs of such impound shall be borne by the operator or owner thereof and such vehicle may not be released until a bond of $500 for each 10,000 pounds of overweight.
      (3)   A person who violates §§ 71.01, 71.03 or Chapter 74, Schedule I will be subject to a fine of $100 for each 2,500 pounds of overweight or additional weight up to 10,000 pounds. For any excess weight over 10,000 pounds, an additional fine of $100 for each additional 1,000 pounds shall be assessed up to $2,500.
      (4)   A person who violates the issuance of a permit under § 71.03(C) shall be subject to a fine not to exceed $750.
      (5)   Any court action involved to enforce the failure to pay such violations will subject the individual to a fine not to exceed $2,500 for each violation, as well as attorney fees and the reporting of the failure to pay to the Bureau of Motor Vehicles for suspension of driving privileges.
   (B)   Any person who violates the provisions of § 71.06 shall be subject to a fine of $100.
