§ 31.096  BOARD MEMBERSHIP; COMPENSATION; TERMS; VACANCIES.
   (A)   The Planning Board shall be composed of nine members who reside within the corporate limits and shall be appointed by the Board of Alderpersons. The same membership shall function as a zoning board of adjustment as provided in Chapter 152 of this code. The actions and decisions by the Planning Board shall not be conducted as part of the regular Zoning Board of Adjustment meeting and shall be conducted during a regular meeting or a special meeting as provided by this subchapter.
   (B)   The Planning Board members shall be appointed by the Board of Alderpersons for three-year staggered terms, and may continue to serve until their successors have been appointed. Vacancies may be filled for the unexpired term only.
   (C)   Members may be reappointed to successive terms without limitations.
   (D)   Planning Board members may be removed by the Board of Alderpersons at any time for failure to attend three consecutive meetings for failure to attend 30% or more of the meetings within any 12-month period or for any other good cause related to performance of duties. Upon request of the member proposed for removal, the Board of Alderpersons shall hold a hearing on the removal before it becomes effective.
   (E)   If a member moves outside the town, that shall constitute a resignation from the Planning Board, effective upon the date of a replacement as appointed by the Board of Alderpersons.
   (F)   Members shall serve without pay, but may be reimbursed for any expenses incurred while representing the Board.
