§ 153.010  VARIANCES AND APPEALS.
   (A)   An interested party may appeal any final order or other decision of the Storm Water Administrator.  All appeals must be filed in a timely manner, but not more than 30 days after a final order or other decision of the Storm Water Administrator. Appeals must be filed on forms obtained from the office of the Storm Water Administrator and must be filed with the Storm Water Administrator. A notice of appeal shall be considered filed when delivered to the Storm Water Administrator’s office in  a form deemed complete  and acceptable to the Storm Water Administrator. The Storm Water Administrator shall enter the date and time of filing on the notice. An Appeals Officer appointed by the Town Board of Alderpersons will consider all the applications for variance or other appeal. The Appeals Officer shall schedule a hearing of the appeal within 14 days of the filing of a notice of appeal and shall rule on the appeal within 14 days of the hearing of the appeal.

A notice of appeal shall be considered filed when delivered to the Town Administrator’s office in a form deemed complete and acceptable to the Town Administrator. The Town Administrator shall enter the date and time of filing on the notice. A Technical Review Committee appointed by the Town Board of Alderpersons will consider an appeal of any decision of the Appeals Officer. The Technical Review Committee shall schedule a public hearing of the appeal within 30 days of the filing of a notice of appeal, shall provide appropriate public notice of that hearing, and shall rule on the appeal within 30 days of the public hearing of the appeal.
