§ 90.171  PERMIT ISSUANCE PREREQUISITES.
   (A)   An owner or possessor of horses, ponies, cows, sheep, goats or fowl must comply with the following provisions before a permit is issued.
      (1)   The horses, ponies, cows, sheep, goats or fowl must be provided with adequate shelter to protect them from the elements.
      (2)   The shelter shall be kept clean, sanitary and free from accumulations of animal excrement and objectionable odors.
      (3)   The shelters shall be kept at a minimum of 75 feet from any property line.
      (4)   Each horse, pony, cow, sheep or goat must have a pasture area of one-half acre.
   (B)   Every person who possesses and maintains horses, ponies, cows, sheep, goats or fowl described in this subchapter on 7-8-1985, shall have 90 days to bring his or her property in compliance with the above provisions, with the exception of divisions (A)(3) and (4) of this section, which shall specifically not apply to these persons.
