(a) Any massage establishment that was validly permitted as of the date of this section to operate as a massage establishment must apply for a massage establishment permit within forty-five (45) days of the effective date of this section. The requirement to have a conditional use permit shall not be imposed in these instances. Every massage establishment permit issued prior to the effective date of this section shall be null and void upon the forty-sixth (46th) day from the effective date hereof. Notwithstanding the foregoing, if an application for a massage establishment permit pursuant to this section is submitted prior to expiration of the current massage establishment permit, the prior permit shall continue in effect until such time as a determination is made by the chief on the new massage establishment permit application.
(b) Permits for uncertified massage therapists and massage practitioners who are otherwise in compliance with all massage regulations in effect prior to the adoption of this section, shall continue in effect until their normal expiration, or for ninety (90) days following the effective date of this section, whichever occurs latest.
