No retail permit shall be issued unless the proposed location of the fireworks stand complies with each of the following requirements:
(a) The proposed location is within a commercial zone or a planned unit development with and underlying commercial zoning designation.
(b) The proposed location is no less than one hundred feet from any structure and no less than three hundred feet from any other fireworks stand.
(c) The stand will be located upon asphalt, concrete, or another surface expressly approved in writing by the city manager or designee;
(d) The proposed location contains a number of parking spaces for use of operators and patrons of the fireworks stand, which under all of the circumstances, is deemed to be sufficient by the city manager or his or her designee;
(e) The proposed location provides for safe and sufficient ingress and egress by members of the public and would otherwise be situated so as to not present any apparent risk to the public health, safety or welfare;
(f) The proposed location has sufficient area so that in the opinion of the city manager or his or her designee, the proposed location will not adversely affect the normal business activity of the commercial center and is compatible with the existing commercial use;
(g) The stand, in the location proposed, would not violate any applicable local, state or federal rule, statute or regulation. (Ord. 663 § 6, 2013; Ord. 584 § 1 (part), 2003; Ord. 577 § 2 (part), 2003).
