(a) All animal manure, excrement, and all other fly breeding materials, shall be removed from all areas of any dairy including, but not limited to, cattle yards, barns, sheds, feeding platforms, and mangers, as often as is necessary to prevent the breeding or harboring of flies.
It is further provided that, in any event, all animal manure, excrement, and all other fly breeding materials shall be removed at least once every seven days. Provided, however, that in the event that there is such precipitation that the removal of animal manure, excrement, and other fly breeding materials is impracticable, any dairy or dairyman may apply forthwith to the city administrator for an extension of time beyond the aforesaid seven-day limitation. The city administrator upon receipt of such application shall grant such extension of time only where he shall affirmatively find and determine that by reason of an unusual amount of precipitation that such removal is impracticable. The city administrator may grant such extensions of time as are necessary or convenient to effectuate his determination.
(b) Notwithstanding any other provision of this chapter, upon forty-eight hours written notice from the health officer, a dairyman shall remove all manure, excrement, and all other fly breeding materials from his dairy as specified in the notice. The notice may be given by delivery to any responsible person on the dairy or by posting in a conspicuous place thereon. The health officer shall have the authority to issue such notice whenever he shall find that the removal of fly breeding materials and/or abatement of fly breeding conditions is necessary to preserve the health and/ or welfare of the community or adjoining neighborhood.
