2.46.020 Issuance of a notice to appear.
In any case in which a person is arrested by a designated public safety officer and such person does not demand to be taken before a magistrate, the arresting officer shall prepare a written notice to appear and shall release the person on his or her promise to appear, in accordance with the provisions of California Penal Code Sections 836.5(c) and 853.6.
