8-1-10: DRIVEWAY PERMITS:
   A.   Permits Required: Prior to starting any site work for the installation of a new driveway or for resurfacing of an existing driveway within the Village, every person must apply for and obtain a driveway permit from the applicable Superintendent of Public Works, or his designee. The fee for the issuance of said a driveway permit is specified in Section 8-1-7(D) of this Village Code, as amended from time to time. No permit is required for only the sealcoating of an existing driveway.
   B.   Application for Permit:
      1.   All applications for such a driveway permit shall be submitted to the Village Clerk on forms provided by the Village for said purpose. Said permit application shall be transmitted by the Village Clerk to the applicable Superintendent of Public Works, or his designee, for his review and approval. The applicable Superintendent of Public Works, or his designee, is authorized to require each application for a driveway permit to meet specifications that allow a proper installation or resurfacing of the driveway to the site in accordance with the standards set forth below.
      2.   Submittals Required for a Driveway Permit:
         a.   Completed permit application;
         b.   A proposal signed by the contractor;
         c.   A current plat of survey;
         d.   Two (2) sets of site plans drawn out;
         e.   A copy of the homeowners' association approval letter, if applicable.
   C.   Posting Permit: When a driveway permit is issued, the applicable Superintendent of Public Works, or his designee, shall sign or affix a seal to the respective building permit which must be clearly displayed on the subject property at all times during the respective driveway installation and/or resurfacing project to signify that a driveway permit has been issued.
   D.   Work on a Driveway Without Permit: Any work on any driveway which requires the issuance by the Village of a driveway permit which is started without such a permit may also result in an authorized agent of the Village issuing a stop order for any driveway work on the subject property and the property owner(s) having to pay a stop order fee in addition to the driveway permit fee before any work may be resumed on the subject property.
   E.   Prior to issuance of a driveway permit by the applicable Superintendent of Public Works, plans for installation and/or resurfacing of a driveway shall be reviewed and approved by the applicable Superintendent of Public Works and shall comply with the following minimum requirements:
      1.   All Driveways:
         a.   A driveway must not project above the connecting point at the curb;
         b.   Culvert must be a minimum of twelve inches (12") in diameter unless an existing Village storm sewer exists to which the culvert shall be connected;
         c.   A driveway must be at least four inches (4") wider than the garage door, if applicable;
         d.   A driveway must not be within five feet (5') of any side lot line; and
         e.   No driveway apron shall exceed twenty-five feet (25') in width.
      2.   Asphalt Driveways:
         a.   Base must be 6" crushed limestone or equivalent; and
         b.   Asphalt must be installed at two and a half inches (2½") lift and rolled to two inches (2") thickness and flared at the curb or sidewalk.
      3.   Concrete Driveways:
         a.   Concrete shall be a minimum of five and a half inches (5½") bag mix;
         b.   Woven wired mesh shall be required;
         c.   Three percent (3%) through eight percent (8%) air entrainment;
         d.   Expansion material shall be installed between the curb and the driveway approach as well as between the driveway approach and the sidewalk;
         e.   Minimum six inches (6") crushed limestone base shall be required; and
         f.   Concrete thickness of six inches (6") shall be required for any driveway approach and for any sidewalk in the driveway. Concrete thickness of four inches (4") shall be required for the driveway on any residential lot.
      4.   Paver Brick Driveways:
         a.   The property owner or contractor shall submit to the Village specifications indicating the amount of base and the amount of bedding;
         b.   Paver brick driveways require a minimum of six (6) to twelve (12) inches of base and one (1) to one and a half (1 ½) inches of bedding. Sub-base must be installed and compacted in four inch (4") lifts;
         c.   Edge restraints must be installed;
         d.   The base, bedding, and paver bricks must each be compacted when installed; and
         e.   The use of paver bricks is not allowed without a letter from the homeowner accepting responsibility for any paver bricks installed within any Village right-of-way.
   F.   Required Inspections: The following inspections of new driveway installations and/or resurfacing of existing driveways (but not including sealcoating of a driveway) are required. Inspections may be scheduled Monday through Friday between seven o’clock (7:00) A.M. and three o’clock (3:00) P.M., with a minimum of twenty-four (24) hours' notice when scheduling such an inspection.
      1.   A pre-construction inspection by an employee of the Village's Department of Public Works before the issuance of the driveway permit.
      2.   A base inspection by an employee of the Village's Department of Public Works shall be required prior to the installation of any asphalt, concrete, or paver bricks.
      3.   A final inspection of the completed driveway by an employee of the Village's Department of Public Works shall also be required in order to ensure compliance with the applicable approved plans.
   G.   Responsibility of Property Owner:
      1.   Installation of any new driveway(s) and/or the resurfacing of existing driveway(s) must comply with the applicable provisions of the Lake Villa Village Code.
      2.   The property owner(s) and the respective contractor(s) shall be jointly and severally responsible for the restoration of the public right-of-way. (Ord. 2008-09-01, 9-24-2008; amd. Ord. 2022-06-04, 6-20-2022)
