5-4-1: ADMINISTRATION AND ENFORCEMENT PROVISIONS:
   A.   Regulations Provided; Notice Of: A copy of this chapter properly certified by the village clerk shall be filed in the office of the recorder of deeds of Lake County, and shall be deemed notice to all owners of real estate of their liability for service supplied to any user of the service of the combined waterworks and sewerage system of said village on their properties.
   B.   Officers' Authority To Enforce Claims: It shall be the duty of the village clerk and such other officers of the village to take all action necessary or required by the laws of the state thereunto enabling to file all claims and liens for money due to the village, as well as interest, penalties thereon, and reasonable attorney fees and other costs of collection, and to prosecute and enforce such claims in the manner, form and time as permitted by the laws of the state of Illinois 1 .    C.   Village Right Of Access: The village of Lake Villa shall have the right of access to any premises served by the combined waterworks and/or sewage system for the reading, inspecting, maintaining, or installation of any and all equipment related to the waterworks and/or sewage system. The village of Lake Villa shall also have the right of access to any premises served by the combined waterworks and/or sewerage system in order to inspect waterworks or sewerage equipment necessary to maintain and efficiently manage said system, if the village believes this equipment is not functioning properly.
Where said inspections and maintenance are not of an immediate or urgent nature, the village of Lake Villa shall arrange for appointments mutually convenient to the owner(s) and/or tenant(s) of the premises served. Any person refusing the village of Lake Villa right of access or refusing to make an appointment to the applicable premises in order to make an inspection, or perform maintenance as defined in this subsection, shall be subject to not only cessation of utility services until the required opportunity to inspect the premises is afforded but also to a penalty as hereinafter provided. The village of Lake Villa shall provide at least a thirty (30) day notice prior to the cessation of utility services for the reasons described in this subsection. (Ord. 2016-04-03, 4-13-2016)
   D.   Penalty: Any person violating the provisions of this chapter shall be subject to a penalty of not less than two hundred dollars ($200.00) per day and not more than seven hundred fifty dollars ($750.00) per day, and a separate offense shall be deemed committed for each day on which a violation occurs or continues. A determination by a court that a violation of this chapter has taken place and the assessment of a penalty thereof shall not preclude the village from seeking a recovery of any unpaid charges, fees or other sums due the village under this or other ordinances because of the furnishing by the village of its utility services.
