4-2-2: DEFINITIONS:
As used in this chapter, the following terms shall have the meanings set forth below:
APPLICABLE TRIBUNAL: Either the administrative adjudication system and/or code hearing department established, maintained, and/or jointly utilized by the village of Lake Villa or the circuit court of the 19th judicial circuit, Lake County, Illinois, as to matters within the respective jurisdiction of such tribunal.
CHIEF OF POLICE: The chief of police of the village of Lake Villa police department.
CHRONIC NUISANCE PROPERTY: Property upon which three (3) or more of the nuisance activities listed below have occurred during any one hundred twenty (120) day period, as a result of any three (3) separate events, the respective facts of which have been independently investigated by any law enforcement agency:
   A.   "Disorderly conduct" as defined in 720 Illinois Compiled Statutes 5/26-1;
   B.   "Unlawful use of weapons" as defined in 720 Illinois Compiled Statutes 5/24-1 et seq.;
   C.   "Mob action" as defined in 720 Illinois Compiled Statutes 5/25-1;
   D.   "Discharge of firearm" as defined in 720 Illinois Compiled Statutes 5/24-1.2 and 1.5;
   E.   "Gambling" as defined in 720 Illinois Compiled Statutes 5/28-1;
   F.   "Possession, manufacture or delivery of controlled substances" as defined in 720 Illinois Compiled Statutes 570/401 et seq.;
   G.   "Public indecency" as defined in 720 Illinois Compiled Statutes 5/11-30;
   H.   "Assault or battery or any related offense" as defined in 720 Illinois Compiled Statutes 5/12-1 et seq.;
   I.   "Prostitution" as defined in 720 Illinois Compiled Statutes 5/11-14 et seq.;
   J.   "Criminal damage to property" as defined in 720 Illinois Compiled Statutes 5/21-1 et seq.;
   K.   "Possession, cultivation, manufacture or delivery of cannabis" as defined in 720 Illinois Compiled Statutes 550/3 et seq.;
   L.   "Illegal consumption or possession of alcohol" as defined in 235 Illinois Compiled Statutes 5/6-16 et seq.
   M.   "Domestic violence" means "abuse" as defined in section 103 of the Illinois domestic violence act of 1986 by a "family or household member" as defined in section 103 of the Illinois domestic violence act of 1986.
OWNER: Any person, entity, firm or corporation having any legal or equitable interest in the property. Owner includes, but is not limited to:
   A.   The person, persons, entity or entities which hold record legal title to a property.
   B.   A mortgagee of a property in whom is vested:
      1.   All or part of the legal title to the property, or
      2.   All or part of the beneficial ownership and the right to the present use and enjoyment of the premises; or
   C.   Any tenant or other occupant who has the right or ability to control what occurs on the property; or
   D.   The beneficiary(ies) of a land trust which holds record legal title to a property.
PERMIT: To suffer, allow, consent to, acquiesce in, to fail to prevent, or expressly assent or agree to the doing of an act.
PERSON: Any natural person, association, partnership, limited liability company, or corporation capable of owning or using property in the village.
PROPERTY: Any real property, including land, which is affixed, incidental or pertinent to land, including, but not limited to, any premises, room, house, building or structure or separate part or portion thereof, whether permitted or not.
RESPONSIBLE PARTY(IES): Any person or persons in actual or constructive possession and/or control of a property, including, but not limited to, an owner of a property, occupant of a property, and/or an owner's agent.
SEXUAL VIOLENCE: Any act of sexual assault, sexual abuse, or stalking of an adult or minor child, including, but not limited to, nonconsensual sexual conduct or nonconsensual sexual penetration as defined in the civil no contact order act and the offenses of stalking, aggravated stalking, criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, criminal sexual abuse, and aggravated criminal sexual abuse as those offenses are described in the criminal code of 2012.
