3-20-4: VILLAGE POLICY RELATIVE TO VIDEO GAMING CAFES:
   A.   Effective August 23, 2017, it is the policy of the Corporate Authorities of the Village to not create any new liquor licenses for any additional video gaming cafes in the Village, because the proliferation of such establishments within the Village will discourage new restaurants from being established within the Village and will thereby reduce the growth in the Village's commercial tax base, except under the exceptions identified in subsection B of this section. For purposes of this section and the Village policy set forth herein, a video gaming cafe is defined as an establishment whose primary or a major focus is video gaming, and the service of alcoholic beverages and/or food is secondary to the video gaming operation. The following factors shall be considered by the Corporate Authorities of the Village when determining if a proposed establishment is a video gaming cafe:
      1.   The layout and design of the establishment;
      2.   The preparation and variety of food and beverages offered;
      3.   The creation and operation of a commercial kitchen on the premises where gaming is situated or a partnership with an establishment that operates a commercial kitchen;
      4.   The proposed number of video gaming machines relative to the proposed customer seating capacity of the establishment must be at least ten (10) customer seats to one video gaming terminal;
      5.   The square footage of space devoted to video gaming relative to the amount of space which will be devoted to other activities must be at least four (4) times as much space for non-gaming activities in comparison to the space which will be devoted to video gaming;
      6.   The sources of proposed or actual revenue derived from an establishment;
      7.   Whether the establishment is proposed to be marketed as a gaming establishment and whether the establishment will have a gambling theme;
      8.   The number of employees of the establishment and their respective proposed functions; and
      9.   Any other factors as determined relevant by the Corporate Authorities of the Village and/or by the Village of Lake Villa Liquor Commissioner.
   B.   Notwithstanding the foregoing, the Corporate Authorities of the Village, in their sole discretion, may, however, consider creating a liquor license for a video gaming cafe if one or more of the following conditions are present:
      1.   The presence of a complementary nearby establishment that serves a variety of food and beverages where another video gaming cafe is not in close proximity; or
      2.   The proximity of the video gaming cafe to another establishment with video gaming terminals; or
      3.   Whether the video gaming cafe offers a unique business opportunity not then present in the Village. (Ord. 2017-08-02, 8-23-2017)
