A. Video Gaming Terminal User Fee: An annual user fee for each calendar year is hereby imposed upon each video gaming terminal located and/or operated in the Village.
B. Village Database Maintained: Each operator of a video gaming terminal within the Village shall provide to the Village the following required information for entry into a database which shall be maintained by the Village relative thereto, which information shall include but not be limited to: (i) the name of the operator of the premises, (ii) the telephone number and email address of the operator, (iii) the address where the video gaming terminals are or will be located, (iv) the number of video gaming terminals on the subject premises, (v) the serial number of each video gaming terminal on the subject premises, (vi) the brand name of the video gaming terminal, (vii) the type of video gaming terminal, and (viii) a copy of the current state license issued to the operator for each such video gaming terminal.
C. Payment of Annual User Fee Required:
1. It shall be unlawful for any person to operate any video gaming terminal within the Village for use by any other person unless the annual user fee thereon pursuant to this chapter has been paid for the current year. It shall be unlawful for any person to install, keep, maintain or use, or permit the installation, keeping, maintenance, or use upon any premises within the Village of any video gaming terminal upon which such annual user fee has not been paid.
2. After providing to the Village the required information for the Village database and a copy of the operator's current state license as set forth in paragraph B hereof and paying the annual user fee required for each video gaming terminal, the operator of the premises where such video gaming terminal(s) is or are located shall be authorized to use and operate each such video gaming terminal for such calendar year.
D. User Fee Specified: Such annual user fee for each video gaming terminal for any calendar year, or portion thereof, before January 1, 2022 shall be twenty-five dollars ($25.00) per terminal for each calendar year. For each calendar year, or portion thereof, beginning on or after January 1, 2022, such annual user fee shall be two hundred fifty dollars ($250.00) per terminal per calendar year.
