§ 153.034  CERTIFICATE OF NONCOMPLIANCE.
   If any development exists for which a final plat has not been approved or for which the standards contained or referred to herein have not been complied with in full, the Planning and Zoning Commission shall pass a resolution reciting the fact of such noncompliance or failure to secure final plat approval, and reciting the fact that the provisions of this subchapter will apply to the development and the lots therein, and the Town Secretary shall, when directed by the Planning and Zoning Commission, cause a certified copy of such resolution under the corporate seal of the town to be filed in the deed records of the county or counties in which such development or part thereof lies. If full compliance and final plat approval are secured after the filing of such resolution, the Town Secretary shall forthwith file an instrument in the deed records of such county or counties stating that § 153.034 no longer applies.
