§ 70.13  ENFORCEMENT; NOTICE.
   (A)   Any police officer for the town shall have the authority to require the immediate abatement and removal of any illegally parked vehicle as provided herein.  The town or a wrecker service under the direction of a police officer may, without the consent or knowledge of the owner or operator of the vehicle, remove and store the vehicle at a vehicle storage facility at the vehicle owner’s expense.
   (B)   For purposes of this section, the last registered owner of the vehicle is responsible for all costs incurred under or other consequences resulting from this section.
   (C)   The town shall give written notice by certified mail, return receipt requested, within two days after the date of removal of the vehicle, to:
      (1)   The last address that the registration records of the Texas Department of Transportation show for the owner of the vehicle, or if the vehicle is registered in another state, the last address that the appropriate agency of that state shows for the owner of the vehicle; and
      (2)   Every lien holder recorded under Tex. Transportation Code Ch. 501, as may be amended from time to time.
   (D)   The notice shall:
      (1)   Describe the vehicle with sufficient particularity to identify the vehicle;
      (2)   Identify the location of the facility that is storing the vehicle (including a valid and working telephone number for the facility);
      (3)   Inform the owner and lien holder of the right to claim the vehicle not later than 170 days from the date of the notice, upon the payment of all towing, preservation, notification and storage charges;
      (4)   State that the owner or lien holder’s failure to claim the vehicle within the period specified is:
         (a)   A waiver by that person of all rights, title and interest in the vehicle; and
         (b)   Consent to the disposal of the vehicle as provided by state law.
   (E)   The town may dispose of the vehicle in any manner allowed by state law.
