It is unlawful for anyone to construct, maintain or operate a private sewer facility within the town other than a connection to the POTW unless it meets the following criteria:
(A) The private sewer facility shall meet the requirements of the Texas Department of Health rules and regulations as contained in Construction Standards for On-Site Sewage Facilities.
(B) All new private sewer facilities or any part thereof may not be constructed on property within 100 feet of any town sewer main.
(C) Existing private sewer facilities may continue in operation if the system conforms to § 53.006(A) of this code.
