(A) Any person who shall violate any provision of §§ 50.001 through 50.007 shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined an amount of not less than $100 and not more than $500. Each day of violation shall constitute a separate offense. Such penalty provision is cumulative of any and all rights the town has to enforce §§ 50.001 through 50.007 through any lawful means including legal action seeking injunctive or other appropriate relief.
(C) (1) It is unlawful for any person, company, firm or association to use water in a method or manner not prescribed by the resolution mentioned in § 50.046 and upon being found guilty thereof, such person, company, firm or association shall be punished by a fine not to exceed $2,000. Each day of violation shall constitute a separate offense.
(2) Each day such unlawful use of water shall continue shall constitute a separate and distinct offense.
(C) It is unlawful for any person, company, firm or association to use water in a method or manner not prescribed by § 50.056 and upon being found guilty thereof such person, company, firm or association shall be punished by a fine not to exceed $2,000. Each day of violation shall constitute a separate offense.
(D) (1) Any person, firm, corporation, partnership, association or any agent or employees thereof, who shall violate any of the rules, regulations or provisions of §§ 50.065 through 50.069, or any part thereof, by any act, either by omission or commission, who is found guilty of any violation of the provisions of this chapter shall be guilty of a misdemeanor and shall be punished by a fine not to exceed $2,000. Each day of violation shall constitute a separate offense.
(2) If the town determines that any willful or continued violation of the terms, conditions and provisions of §§ 50.065 through 50.069 is occurring, the town, in addition to imposing the penalty set forth above, may institute any appropriate action or processing in any court having jurisdiction to restrain, correct or abate such violations. The authority of the town to seek civil action to restrain, correct or abate a violation shall, in no way, prevent or preclude the town from pursuing prosecution for a misdemeanor offense. The town shall have the right to pursue both misdemeanor prosecution and/or civil action to secure compliance with the terms of that subchapter at its discretion.
(E) Any person who shall violate any provision of §§ 50.080 through 50.085 shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2,000. Each day of violation shall constitute a separate offense. Such penalty provision is cumulative of any and all rights the town has to enforce §§ 50.080 through 50.085 through any lawful means including legal action seeking injunctive or other appropriate relief.
