§ 31.134  POWERS AND DUTIES.
   The Town Administrator shall:
   (A)   Be responsible for the proper administration of all affairs of the town;
   (B)   Recommend the appointment and removal of all department heads except the Police Chief to the City Council;
   (C)   Recommend to the Mayor the appointment and removal of all subordinate employees of the town;
   (D)   Direct and supervise the administration of all departments, offices and agencies of the town;
   (E)   Recommend to the City Council a standard schedule of pay, including minimum, intermediate and maximum ranges, and a uniform personnel policy for all town employees;
   (F)   Attend all City Council meetings, unless excused in writing by the Mayor, and shall have the right to take part in discussions, but shall have no vote;
   (G)   Attend all board and commission meetings; the Town Administrator may designate a department director to attend in his or her place;
   (H)   Assist the Mayor in ensuring that the laws of the state and ordinances of this town and other acts of the City Council subject to enforcement by the Town Administrator, or by officers subject to the Town Administrator’s direction or supervision, are faithfully enforced;
   (I)   Assist the Mayor in the preparation of the annual draft budget and draft capital improvement budget for the City Council. The Town Administrator is responsible for the implementation, monitoring and administration of the annual budget;
   (J)   The Town Administrator may transfer resources in the amount budgeted between departments as the need may arise, but may not increase the total amount appropriated for each fund type without City Council approval through a formal budget amendment; all such transfers shall be ratified by the City Council during a midyear budget review;
   (K)   The Town Administrator may authorize department heads to transfer resources in the amount budgeted within their respective departments;
   (L)   Recommend to the City Council adoption of such policies, measures, ordinances and resolutions as may be deemed necessary or expedient for the health, safety or welfare of the community, or for the improvement of the operation of the town;
   (M)   Prepare such other reports as the City Council may require concerning the operations of town departments, offices and agencies subject to the Town Administrator’s direction and supervision;
   (N)   Keep the City Council advised as to the financial condition and future needs of the town;
   (O)   Investigate all complaints in relation to the administration of the town;
   (P)   No contract may be let except by the Mayor, unless the Town Administrator is specifically authorized to do so by the City Council on their behalf;
   (Q)   Administer the purchase of all materials, supplies and equipment for which funds are provided in the budget; and purchase materials and supplies necessary for operation of town services for amounts up to and including $25,000 and less than $50,000 for items approved as line items in the budget or with the approval of the City Council to the extent funds have been provided in the budget. All purchases of $50,000 or more shall be made in accordance with the competitive bidding requirements. No purchase shall be made, contract let, or obligation incurred which exceeds the current budget appropriation without a supplemental appropriation by the City Council;
   (R)   Perform such other duties as are specified or may be required or directed by the City Council.
