§ 31.002  PLANNING AND ZONING COMMISSION.
   (A)   There is hereby created and established for the Town of Lakeside, Texas, a Planning and Zoning Commission, which shall be composed of five members.  The members shall be resident citizens of the Town of Lakeside and qualified voters.  All members of the Planning and Zoning Commission shall be appointed by a majority of the members of the City Council attending a meeting at which appointment to the Commission is considered.  In the event of a tie vote on the appointment of a person to the Planning and Zoning Commission, the Mayor may vote to break the tie in order to appoint a person to the Planning and Zoning Commission.  Each member of the Planning and Zoning Commission shall be appointed to a place number on the Planning and Zoning Commission, and those places shall be Place 1, Place 2, Place 3, Place 4, and Place 5.  All appointments shall be for a term of two years, save and except for appointments that fill vacancies that occur in the Planning and Zoning Commission.  Persons who are members of the Planning and Zoning Commission as of the date of passage of this section shall continue to be members of the Commission, except where appointment is required by the terms of this section at the time of its passage.
   (B)   Upon the effective date hereof and at a regularly called and scheduled meeting of the City Council of the Town of Lakeside held in July of each year, the City Council shall appoint persons to serve as members of the Planning and Zoning Commission.  In even-numbered years, the City Council shall appoint members to fill Place 2 and Place 4 of the Planning and Zoning Commission.  In odd-numbered years, the City Council shall appoint persons to fill Place 1, Place 3, and Place 5 of the Planning and Zoning Commission.
   (C)   A person appointed to the Planning and Zoning Commission may be removed from the position by a vote of a majority of the City Council attending a meeting at which removal from the Commission is considered.  In the event of a tie vote, the Mayor may cast a vote to break the tie in order to make a determination of whether the member shall be removed.  Any member appointed to the Planning and Zoning Commission may resign his or her position at any time.  All vacancies occurring on the Planning and Zoning Commission shall be filled for the unexpired term of that position in the same manner as provided for the original appointment of a person to the Planning and Zoning Commission.
   (D)   All members of the Planning and Zoning Commission shall serve without compensation.
