§ 12.08.110 AMERICANS WITH DISABILITIES ACT ACCESSIBILITY GUIDELINES FOR BUILDINGS AND FACILITIES.
   A.   Standards and specifications set forth in Title 41, Chapter 9, Article 8, Arizona Revised Statutes (Arizonans with Disabilities Act) and the Americans with Disabilities Act of 1990, as amended, and its implementing rules and regulations, including the 2010 ADA Standards for Accessible Design, applicable to public entities, accommodations, and commercial facilities, are hereby adopted and incorporated as an amendment to the International Building Code adopted in § 12.08.040. Such standards and specifications shall apply to new construction and alterations as required by law and are not required in buildings or portions of existing buildings that do not meet the standards and specifications.
   B.   Accessible parking spaces shall comply with § 12.08.110 standard details titled “Lake Havasu City Universal Handicap Space Standards” and “Lake Havasu City Handicap Sign Standards”within the jurisdiction of Lake Havasu City. Such standards and specifications shall apply to new construction and alterations requiring permitting. Whenever a parking area built before the effective date of this section does not have sufficient accessible parking spaces to comply with state and federal laws, existing non-accessible parking spaces may be combined and converted to required accessible parking spaces and associated access aisles. The parking area will be legally nonconforming if the total number of spaces drops below current ordinance requirements.
