(A) The building activity area shall be determined based on review of the materials submitted by the applicant and a site visit by city staff. The building activity area shall minimize impact on trees.
(B) It is the intent that the building activity area will conform to the setbacks applicable in the zoning district.
(C) However, due to the presence of one or more trees deemed by size or condition to be worthy of preservation, a variance from a required setback may be considered by the Zoning Board of Appeals.
(D) The fees for a variance request may be waived by the Director of Community Development.
