§ 91.052 BITING AND ATTACKING DOGS.
   (A)   It shall be the duty of the owner of any dog to prevent such dog from biting or attacking any person or other animal in the city. Any dog which may unprovokedly bite or attack any person or other animal in the city is hereby declared to be a public nuisance and such dog may be apprehended and impounded by any police officer, community service officer, animal warden or other person charged with the enforcement of this section.
   (B)   If such dog is impounded, the owner shall have no right to redeem the dog if it has without provocation attacked or bitten any person or persons or other animal in the city on two or more occasions within any 24-month period, unless he or she shall remove such dog from the city immediately upon redemption and shall not thereafter keep, harbor or otherwise maintain such dog in the city at any time.
