§ 156.046 CITY ACCEPTANCE OF PUBLIC IMPROVEMENTS.
   (A)   The City Council shall consider the acceptance of public improvements by resolution upon completion of the following:
      (1)   Developer has transferred a minimum of 50% of the lots to third party purchasers; and
      (2)   Construction of principal buildings is completed and certificates of occupancy have been issued for 50% of the lots; and
      (3)   The City Engineer has verified the overall development site is maintained in a good and serviceable condition as required by the subdivision agreement; and
      (4)   Certification by the City Engineer that all improvements, consistent with the approved engineering plans, have been completed, inspected and determined to be in full compliance with the Lake Forest Engineering and Construction Standards, as amended; and
      (5)   Delivery of the guarantee security required for the improvements to be accepted; and
      (6)   All fees due to the city are paid in full.
   (B)   The acceptance resolution may modify or waive any of the foregoing requirements, and the City Council may condition such acceptance as set forth in the terms of the acceptance resolution.
