§ 156.029 FINAL PLAT OF SUBDIVISION; PROCEDURES FOR REVIEW AND APPROVAL.
   (A)   Complete application. Upon determination by the Director of Community Development that the applicant has submitted a complete application for final plat of subdivision approval, and after staff review and determination that said plat conforms to this chapter, other pertinent ordinances of the city and the City Comprehensive Plan of 1998 as it may be amended from time to time, with the general design and layout of similar areas of the city as required by the city’s Charter, and with all conditions of tentative approval, such application shall be scheduled for Plan Commission review.
   (B)   Public notice. Public notice must be provided in accordance with § 156.027(B).
   (C)   Plan Commission review of final plat of subdivision.
      (1)   (a)   If the final plat is found to conform to the requirements of this chapter, all of the conditions of the tentative plat approval and other pertinent ordinances of the city, the Plan Commission shall recommend approval of the final plat to the City Council by a motion of the Commission.
         (b)   The final plat shall be delivered to the City Council, along with the findings in support of approval as determined by the Plan Commission.
         (c)   If the Plan Commission approves the final plat with conditions, the petitioner is responsible for delivering to the Community Development Department any revised plans or further documentation evidencing compliance with such conditions prior to final City Council consideration and within one year of the date of the Plan Commission’s motion to recommend final plat approval.
         (d)   Failure to do so may result in rescission of all previous approvals.
      (2)   (a)   If it is determined by the Commission that the final plat does not conform to the provisions of this chapter, to other pertinent ordinances of the city or to the conditions of tentative plat approval, the Plan Commission may:
            1.   Continue the matter to allow the petitioner to make revisions or provide additional information; or
            2.   Recommend denial of the final plat to the City Council with supporting findings.
         (b)   Alternatively, the petitioner may withdraw the application.
   (D)   City Council review of final plat.
      (1)   Upon receipt of a recommendation from the Plan Commission regarding a final plat, the City Council shall consider the findings presented by the Plan Commission and assess whether the proposed final plat is in conformance with the requirements of this chapter and other pertinent ordinances.
      (2)   The City Council may:
         (a)   Approve the final plat and in the case of a planned preservation subdivision, the associated special use permit;
         (b)   Remand the matter to the Plan Commission with direction for further modification and consideration; or
         (c)   Deny the application.
      (3)   If the application is denied, resubmittal requires full compliance with the requirements in this chapter beginning with submittal of an application for review and approval of a tentative plat of subdivision. Submittal of an application for tentative plat approval, in the same form as the application receiving denial, is precluded for a period of 12 months from the date of the denial.
   (E)   Duration and extension of approvals. Final plat approval shall be valid for 12 months from the date of City Council approval, during which time, all requirements for recordation of the final plat must be met to the satisfaction of the city.
