§ 156.006 VARIANCES.
   (A)   Upon written request from an applicant on forms provided by the Director of Community Development, the Plan Commission may recommend variances from the requirements of this chapter in specific cases where the applicant demonstrates, to the satisfaction of the city, that extraordinary hardships or practical difficulties, unique to the site, would result from strict compliance with the requirements of this chapter.
   (B)   Conditions resulting from the actions of any current or previous owner of the property shall not be deemed hardships or practical difficulties.
   (C)   Any such variance shall not allow for density greater than that permitted by the applicable provisions of the Zoning Code or be detrimental to the public safety, health or welfare of the surrounding area or overall community, as determined by the city.
   (D)   All such recommended variances shall be communicated to the City Council in writing along with written findings supporting the Commission’s recommendation, so that the City Council may consider any variance request prior to City Council consideration of a final plat of subdivision.
   (E)   The Plan Commission may recommend, and the City Council may impose, conditions on any grant of variance.
