Any person who performs any of the following acts with a person not his or her spouse commits the offense of patronizing a prostitute:
(A) Engages in an act of sexual penetration or sexual conduct with a prostitute; and/or
(B) Enters or remains in a place of prostitution on with intent to engage in an act of sexual penetration or sexual conduct.
