(A) In case of violations of this subchapter, a written notice shall be immediately served by the Director of Community Development, or his or her designee, on the owner, contractor or person on the site in charge of or responsible for the work. The job site shall be posted with a notice of violation and the Director of Community Development or his or her designee may immediately stop all work on the entire premises or any portion thereof.
(B) If the written notice is respected and immediate steps are taken to conform with the requirements of this subchapter, then the deviation observed shall not be considered a willful violation and shall not be subject to penalty as herein provided.
(C) If the written notice has not been respected and the condition corrected within 24 hours, the Director of Community Development may consider the deviation a willful violation of this chapter and shall issue a written order stopping all work on the premises until compliance with all code requirements have been assured.
