   THIS LEASE is entered into on the ____ day of ___________ 20____, by and between the like COUNTY COMMISSIONERS, hereinafter referred to as ''County'' and hereinafter referred to as ''Renters".
   I.
   RECITALS
   In consideration of the mutual covenants and agreements in this Lease, and for other good and valuable consideration, County does hereby lease to Renters, and Renters do hereby lease from the County, the premises situated at 889 South Court Street, Crown Point, Lake County, Indiana:

   PROPERTY COVERED BY LEASE
   This Lease covers the real estate and all personal property only located and described in paragraph I above, along with all parking areas and other areas used and which are appurtenant to these areas and used by the Renters or their guests/customers for the event.
   III.

   RESPONSIBILITIES OF THE PARTIES
A.   The Renters shall be responsible for the following for any and all activities conducted on the lease premises during the lease period:
   1.   Indemnifying and holding harmless the Lake County Board of Commissioners, Lake County, Indiana, its elected officials, its appointed officials, its employees, and its agents and naming them as additional insured parties on Renters liability policy as indicated in the Lake County Fairgrounds Rental Rules incorporated herein, against any and all activities conducted on the leased premises during the lease period including, but not be limited to, damages of any kind, any and all personal injuries, workman's compensation claims or claims for damages, along with all attorney's fees incurred by Lake County, as a result of Renters using and leasing said facilities.
   2.   Providing and paying the cost of law enforcement, security, and traffic control personnel for activities on the leased premises during the lease period. The Renters hereby understand that any law enforcement, security and/or traffic control personnel mentioned herein are not employees of the county or any office of Lake County government, and work solely at the discretion of the Renters.
   3.   Indemnifying and holding harmless the Lake County Board of Commissioners and Lake County Fairgrounds, its elected officials, its appointed officials, its employees and its agents from any and all damages and attorney's fees for any claim or action filed because of any act of any Lake County, Indiana employee or volunteer, any of Renters' guests or customers and any security personnel hired by the Renters.
   4.   Reporting to the County and paying for any and all damage to the leased premises caused by the Renters, its contractors, employees, agents, customers, invited guests, and any individuals who attend the event described in paragraph l (B) above.
   5.   To conduct all activities of said event in accordance with all applicable local ordinances and laws of the State of Indiana.
   6.   Ensuring compliance with the following in the conduct of any and all activities on the leased premises during the lease period:
   a.   No person shall, on the grounds of race, color, national origin or sex, be excluded from participation, be denied the benefits of, or be subject to discrimination.
   b.   The principles of equal opportunity in employment and delivery of services are applicable and the Renters commit to a policy and practice of nondiscrimination and affirmative action based upon age, military service, ancestry, color, national origin, physical handicap, political affiliation, race, religion and sex.
   c.   This Lease incorporates herein the Lake County Fairgrounds Rental Rules ("Rental Rules") attached hereto as Exhibit ''A'' and Renters hereby acknowledge and agree to all terms of said Rental Rules.
   7.   The County shall not be responsible for any activities conducted on the leased premises during the lease period and shall not manage, control, or operate, in any way, any activity s or have any involvement with the event described herein other than the obligations contained withier this Lease.
   VI.
   CONTACT PERSON
   County and Renters shall designate an individual as their contact person for all activities prior to and after the lease period who shall work out any details in preparation for the event and for any action to be taken subsequent to the event in relation to each party's specific responsibilities under this Lease.

   RENTAL RULES
   1.   Any and all functions selling merchandise or engaging in the exchange of money require a security officer to be present at all times during the operation of the event. In addition, any and all functions which serve and/or sell alcohol require a security officer to be present at all times during the event. Said security officers shall be limited to off-duty Lake County Sheriff's Department personnel. Renters understand that said security officers who are off-duty Lake County Sheriff's Department personnel are not performing duties as a Lake County, Indiana or Lake County Sheriff's Department employee, but are being employed by Renters personally and shall be the responsibility of the Renters and not of Lake County, Indiana or the Lake County Sheriff's Department. Under no circumstances shall Renters' security officer be considered an employee of Lake County, Indiana or the Lake County Sheriff's Department, but is solely the employee of the Renters.
   2.   Based on the nature of the event held by the Renters, the County will determine the necessity and the number of security officers required for said event in accordance with this policy outlined above. The Renters will pay each security officer twenty- five dollars ($25.00) per hour and is strictly and totally responsible for making said payment to each security officer. Payment is due at the completion of the event. Security officers will be paid and will stay until lights are out and doors are locked, when event is past normal closing time of Dusk.
   3.   Reservation requests will be tentative for fourteen (14) days. Down payment must be made within fourteen (14) days of said request, or date(s) will be reopened. Reservations shall be paid in full, 31 days prior to event or shall incur a ten percent (10%) late fee.
   4.   Certificates of Liability insurance indemnifying and holding harmless the Lake County Board of Commissioners, Lake County Fairgrounds and Lake County, Indiana, its elected officials, its appointed officials, its employees and its agents are required for building rental and may be required for other events at the discretion of the County. Minimum coverage of said indemnifying liability insurance shall be one million dollars ($1,000,000.00). Insurance indemnification certificates, as defined herein, must be received ten (10) days prior to the event or the event shall be cancelled. Reasonable extensions of the submission of insurance indemnification certificates shall be allowed at the sole discretion of the County.
   5.   ALL WALKS/RUNS/BIKE RIDES AND/OR ANY EVENTS THAT HAVE ANY TYPE OF AMUSEMENT DEVICE (i.e. JUMPING DEVICE, DUNK TANK, ETC.) ARE REQUIRED TO HAVE THE AFOREMENTIONED INSURANCE.
   6.   Events charging admission, either as a ''door'' charge for admittance to a building and/or a gate charge for admittance to the fairgrounds shall pay, in addition to the Total Rent indicated in paragraph IV of the Lease, the sum of fifty cents ($.50) per head per building admission and one dollar ($1.00) per head per gate admission. These additional costs shall be paid to the Lake County Fairgrounds no later than thirty (30) days after said event.
   7.   Set-up time with a fully paid reservation may start the day before the event from 2:00 p.m. to 9:00p.m. Additional setup time will require the payment of additional fees and will only be allowed if the additional time requested is available.
   8.   THERE SHALL BE ABSOLUTELY NO UNAUTHORIZED SALE OF ANY ITEMS WHATSOEVER BY RENTERS, EMPLOYEES, GUESTS, CUSTOMERS, VENDORS, ETC. FROM ANY PRIVATE OR COMMERCIAL VEHICLES IS STRICTLY PROHIBITED (with the exception of food trucks or other ''vendor vehicles'' as specifically indicated initial Application).
   9.   IRS approved Not-For-profit (NFP) organizations MUST provide proof of their NFP status when making a reservation in order to receive NFP pricing.
   10.   Shelters contain approximately 25 picnic tables and 2 serving tables. Any change to this number is the responsibility of the Renters. Additional fees will be charged for Lake County Fairgrounds staff members to make any changes.
   11.   The 4-H Building is the only building that includes tables and chairs in the rental fee. Tables and/or chairs for ANY OTHER BUILDING are the responsibility of the Renters.
   12.   THE SALE OF FOOD OR BEVERAGE PRODUCTS must be conducted in full compliance with the Lake County Health Department regulations. These may be obtained by calling 219-755-3655. Any licenses, permits, etc. required must be obtained and paid for by the vendor.
   13.   THE SALE AND/OR SERVICE OF ALCOHOLIC BEVERAGES must be done in accordance with all applicable local ordinances and state laws including, but not limited to, no sales/service to minors, proper licensing of bartenders/servers (if applicable), and dram shop laws. Further, Renters' hold harmless provisions contained within the Lease of Space at the Lake County, Indiana Fairgrounds shall apply to the sale/service of alcoholic beverages. Any licenses, permits, etc. required must be obtained and paid for by the vendor.
   14.   NO DUCT TAPE OR PERMANENT MARKINGS ARE ALLOWED TO BE PLACED ON ANY BUILDING FLOOR BY ANYONE. NO MARKINGS, INCLUDING BUT NOT LIMITED TO, STARTING POINTS, FINISH LINES, ROUTES, ETC., ARE ALLOWED ON OUTSIDE PAVEMENT FOR WALKS/RUNS, OR ANY EVENT. Walks/Runs should be marked with signage, which shall be removed immediately after the event.
   ABSOLUTELY NO STAPLES IN PICNIC TABLES!
NO BANNERS ALLOWED ON DECORATIVE/WROUGHT IRON LOOK FENCE. ANY QUESTIONS PLEASE CALL THIS OFFICE @ 219-661-3071.
   15.   The Renters will maintain the facilities and restrooms during their event. NO SMOKING ALLOWED INSIDE BUILDINGS AT ANY TIME, INCLUDING SET-UP TIME.
   16.   The Renters will turn off all lights and lock all doors at the end of the event and leave the premises in a clean condition. Tables and chairs, if applicable, shall be taken down. All decorations will be removed, including staples, tape, or any other adhesive medium.
   17.   The Renters must arrange to pick up keys/instructions between 7:00 am. and 3:00 p.m. ALL KEYS AND/OR OTHER EQUIPMENT PROVIDED MUST BE RETURNED WITHIN 24 HOURS OF EVENT CONCLUSION. Drop box is located at maintenance shop.
   18.   Music and festivities in buildings will end at midnight and the building must be cleaned and vacated by 1:00 a.m. OUTDOOR MUSIC WILL CEASE BY 10:00 p.m.
   19.   HELIUM BALLOONS ARE NOT ALLOWED INSIDE OF INDUSTRIAL BUILDING.
   20.   Parking in a safe and courteous manner responsibility of the Renters. No parking in grass. Vehicles may be towed at renter's expense.
   21.   NO POLITICAL SOLICITATIONS ARE ALLOWED ON THE GROUDS with the exception of Election days. No Unauthorized Vendors.
   22.   ALL USERS ARE REQUIRED TQ RETURN BUILDINGS TO MOVED IN CONDITION IN ORDER TO RECEIVE CLEAN-UP DEPOSIT.
   23.   Maintenance employee is on the grounds from 7:00 am. to 3:00 p.m. daily. You may contact someone at 219-661-3054.
   Lease Of Space And Rental Rules For The Lake County, Indiana Fairgrounds Acknowledgment
This Acknowledgment must be signed below upon receipt of the LEASE OF SPACE AND RENTAL RULES FOR THE LAKE COUNTY, INDIANA FAIRGROUNDS, and returned with your application.
I accept and acknowledge the policies of the Lake County, Indiana Fairgrounds as contained within the Lease of space And Rental Rules For The Lake County, Indiana Fairgrounds.
   SALE OF FOOD AND/OR BEVERAGES
   The sale of any food and/or beverages, non-alcoholic and alcoholic, must be conducted in full compliance with the Lake County Hea1th Department regulations arid state and local laws. As Renters, it is your responsibility to be sure your food and/or beverage (non-alcoholic and alcoholic) vendor(s), including sampling and pre-packaged food, have received a Temporary Food Permit. You may contact the Lake County Health Department at 219-755-3655 between the hours of 8:30 am. to 4:00 p.m. IF YOU DO NOT HAVE A VALID PERMIT, YOU MAY NOT OPEN YOUR EVENT.
