(A) General.
(1) The Public Works and Transportation Committee shall consider the report of the County Engineer prepared in accordance with § 72.47. The Public Works and Transportation Committee may also request, for its consideration, a relevant review by the State’s Attorney.
(2) The Public Works and Transportation Committee shall have the sole responsibility, and complete discretion in determining whether an application, or any part thereof, is rejected or accepted and shall act to reject or accept all applications, or any part thereof, as contained in the report of the County Engineer within 15 days. The Public Works and Transportation Committee may take into account in its decisions any written comments submitted to the County Engineer from persons having a financial interest in property fronting on proposed connecting sections that may be the subject of an application or any part thereof.
(B) Variations.
(1) The Public Works and Transportation Committee shall have the authority to grant any variations to this chapter that it deems necessary and appropriate to further the purposes of this chapter, including but not limited to the following general provisions of § 72.45:
(a) The renewal terms (see § 72.45(A)).
(2) The Public Works and Transportation Committee shall not have the authority to grant any variances to this chapter and thereby approve any application, or part thereof, that would violate any of the following provisions of this chapter:
(a) Sections unavailable due to maintenance or construction conflicts (see § 72.45(C)(1); or
(b) Snowmobile signing accommodation program agreements not in accordance with § 72.50 and the form adopted by the Lake County Board.
(C) Notification of final action.
(1) The County Engineer shall have prepared a listing showing the final action of the Public Works and Transportation Committee regarding the staff report.
(2) The action of the Public Works and Transportation Committee shall be final.
(3) The Lake County Division of Transportation shall request those associations that were approved for particular connecting sections and/or cross-connections to sign and return to the Division of Transportation the prepared Snowmobile Signing Accommodation Program Agreement with the appropriate fee and required insurance certificates. The Snowmobile Signing Accommodation Program Agreement shall be as approved by the County Board and available from the Lake County Division of Transportation.
(D) Required documents/fees. The Snowmobile Signing Accommodation Program Agreement shall not be considered signed if the returned agreement does not contain the required insurance certificates or the required fees.
