§ 72.45 GENERAL PROVISIONS.
   Applications that are judged complete shall be further reviewed by the Division of Transportation as follows.
   (A)   Renewal terms. Renewals shall be recommended for additional terms, unless an association has not met the terms, requirements and procedures of this chapter in the prior year as determined by the County Engineer.
   (B)   Duplicate applications. Whenever two or more associations have submitted applications for the same connecting section, or cross section, or both, the Division of Transportation shall attempt to reach an agreement with the respective association coordinators as to priority, it being the intent of this provision to avoid overlapping Snowmobile Signing Accommodations. If no agreement is reached, then the Division of Transportation shall decide which Snowmobile Signing Accommodation shall have priority. This section does not apply to renewal applications.
   (C)   Restrictions. The sections of county highways available for use for connecting sections and cross-connections shall not include the following:
      (1)   Those sections of county highways not to be made available due to conflicting ongoing or pending road maintenance or construction, or to conflicting ongoing or pending utility maintenance or construction as determined by the County Engineer;
      (2)   Those sections of county highways where no separation currently exists between the right-of-way line and the adjacent roadway of more than ten feet;
      (3)   Applications not involving connecting snowmobile trails; and
      (4)   Travel of snowmobiles proposed to not be in the same direction of travel of adjacent traffic flow of the adjacent roadway as described on the application.
   (D)   Endorsements. The applications for particular connecting sections and/or cross- connections must include the written endorsement of the municipality or municipalities through which the connecting section and/or cross-connection traverses.
