8-2-2-1: USE OF PUBLIC SEWER REQUIRED; EXCEPTION:
A.   Use Required: No person occupying, owning or having any interest in any lot, grounds, building, dwelling, store, house, shed, barn or any other structure in the village shall discharge sewage from any such premises into or upon any highway, stream, the beach of Lake Michigan, watercourse or public place. All sanitary sewage shall be discharged into a public sewer installed under the authority and approval of the village.
B.   Septic Tanks Excepted:
   1.   Condition For Use Of Septic Tanks: With respect to any premises having an area of not less than two and one-half (21/2) acres, and located more than one thousand three hundred twenty feet (1,320') from any public sewer, the board of trustees, upon application of any person, may approve the installation of a septic tank. Any such septic tank installation shall comply with the state statutes and the rules and regulations of the county environmental protection agency.
   2.   Permit Required; Fee: Upon approval by the board of trustees of the installation of a septic tank system, an application shall be required for a permit for such construction in accordance with the provisions contained in the plumbing regulations, title 9, chapter 6 of this code. A fee as set out in section 1-12-3 of this code, under the category "construction/building fees", shall be paid for each permit for the installation, construction, reconstruction, alteration or repair of a septic tank system, or any portion thereof.
