9-14-20: DEMOLITION REVIEW FOR BUILDINGS MORE THAN 50 YEARS OLD:
A.   Review Required; Purpose. The Commission will review any proposed Demolition of a Building that is over 50 years old that is not subject to another Review under this Chapter in order to evaluate if the subject Building(s) satisfies the criteria for designation provided in Section 9-14-15.
B.   Who May Apply. Any Qualified Representative may apply, as or on behalf of an Owner, for Demolition Review.
C.   Application. In addition to the general requirements of Section 9-14-10 concerning applications, the applicant must provide:
1.   A complete Demolition Letter of Intent; and,
2.   A complete demolition review questionnaire, as the Commission may establish from time to time by resolution duly adopted.
D.   Public Notice (Sign). The Village will provide one or more signs for the subject property announcing the Demolition Review as provided in Section 9-14-10.
E.   Procedure. Upon receipt of a complete application and upon reasonable notice to the applicant, the Commission will conduct its review at a regular or special meeting of the Commission. The Commission will examine whether the subject Building or other Features on the Property meet the criteria for designation provided in Section 9-14-15. Following an initial review meeting, the Commission may continue its review at subsequent meetings or may allow the delay period to elapse without any further consideration.
F.   Maximum Review Duration (Demolition Delay). A delay of 90 days applies following the submittal of a complete application. After the delay expires, the applicant may notify the Building Commissioner in writing that it no longer intends to participate in the Demolition Review process. After such notification, and notwithstanding any determination of the Commission, the Demolition Review is terminated; the Work is Authorized; and the Building Commissioner will evaluate the Work strictly on its merits under all other Village codes and regulations. The 90 day delay period is modified under the following conditions:
1.   Termination by Commission. The Commission may terminate its review at any time after it determines that the subject Building does not satisfy the criteria for designation provided in Section 9-14-15; provided, that the Commission is not required to terminate its review upon such a finding. The Commission may not terminate its review under this Subsection unless the sign required by this Section has been posted for at least seven days.
2.   Termination by Designation. If any Feature on the Property is or becomes a Protected Feature, it is ineligible for Review under this Section. The Work is thereafter subject to Advisory Review. Where a pending application causes a Feature to become Protected, but the application ultimately fails, such failure is Authorization for the Work.
3.   Extension by Village Board of Trustees. The Village Board of Trustees may, in its sole discretion and by resolution duly adopted, extend the time period for up to an additional 30 days where it determines that an extension will promote the purpose of this Section, the purpose and goals of this Chapter, and the public welfare without causing undue hardship on the applicant, which resolution will set forth what objectives the Village Board aims to achieve during the extension.
