A. Police Authority To Enforce: It shall be the duty of the chief of police and the police officers of the village to patrol the streets in the village and to make arrests for violations of the provisions of this title. (1970 Code § 25.54)
B. Penalties And Fines Imposed:
1. Misdemeanor Violation: It is a misdemeanor for any person to violate any of the provisions of this title unless such violation is by any other act or law of this state declared to be a felony.
2. Misdemeanor Penalty:
a. Penalty: Every person found guilty of a misdemeanor for a violation of any of the provisions of this title for which another penalty is not provided shall be punished by a fine of not less than five dollars ($5.00) nor more than the maximum provided in section 1-4-1 of this code for each offense. b. Remittance Of Fines; Failure To Pay: Fines shall be remitted in the amount of twenty five dollars ($25.00) for any such offense. Upon the failure of the violator to pay said fine within five (5) village business days, a second notice may be sent no earlier than ten (10) days after the first notification of violation, and the fine therefor may be paid in the same manner, but shall be in the amount of fifty dollars ($50.00). Upon failure of the violator to pay said fine after a second notice within twenty (20) days thereafter, a final notice may be sent, no earlier than thirty (30) days after the second notice of violation, and the fine therefor may be paid in the same manner, but shall be in the amount of seventy five dollars ($75.00). Nothing contained herein shall be deemed to require giving of any additional notice after the first notification is made. The transmittal of a notice by registered or certified mail shall be deemed sufficient notice, if mailed to the last known address of the violator, and notice shall be deemed to have been accomplished even if there is a failure or refusal of the individual to whom the notice is sent to receipt or accept the same. All fines paid pursuant to the provisions contained herein shall be accompanied by a signed plea of guilty, and a waiver of hearing. (Ord. 96-21, 8-26-1996)
c. Suspension Of Driving Privileges: In addition to any fines or penalties herein provided for the violation of provisions of this title, any court of record may, upon conviction therefor in such court, enter an order prohibiting such person so convicted from driving a motor vehicle in this state for a period not exceeding one year. A violation of such order shall constitute a contempt of court and may be punished accordingly. (1970 Code § 25.55)
d. Excess Load Limits; Fine Pursuant To Statute: Any person violating any of the load limit provisions of section 6-7-5 of this title shall be fined in the amount as set forth in the provisions of the Illinois motor vehicle code, 625 Illinois Compiled Statutes, in effect from time to time for the excess load limits, but not to exceed the amount otherwise permitted by the statutes of the state for violations of municipal ordinances. C. Disposition Of Fines And Penalties; Duties Of Officials:
1. Fines and penalties recovered under the provisions of this title shall be paid over to the village treasurer.
2. Failure, refusal, or neglect on the part of any judicial or other officer or employee receiving or having custody of any such fine or forfeiture to account for or pay over any such fine or forfeiture to the village treasurer shall constitute misconduct in office and shall be grounds for removal therefrom. D. Liability Of Owner Or Operator: It is unlawful for the owner or any other person employing or otherwise directing the driver of any vehicle to require or knowingly to permit the operation of such vehicle upon a street of the village in any manner contrary to this title. (1970 Code § 25.57)
