6-7-5: SIZE, WEIGHT AND LOAD:
A.   Definitions: Definitions of any terms or words used herein shall be in accordance with the provisions of the Illinois motor vehicle code, and weight computations shall be computed in accordance with the Illinois motor vehicle code, 625 Illinois Compiled Statutes.
B.   Permit Required For Overweight Vehicles: It shall be unlawful for any person or entity to drive, operate, move on, upon or across, or for the owner to cause or knowingly permit to be driven, operated or moved on, upon or across any street in the village, under the jurisdiction and control of the village, any vehicle of any nature and description exceeding four (4) tons per axle, or twenty four thousand (24,000) pounds per vehicle, when there will be two (2) or more such movements of such vehicles in the village during any twenty four (24) hour period, without a permit approved by the village administrator. Such permits shall set forth the routes of travel permitted for such vehicles, the speed limit permitted, the maximum number of vehicles permitted in any day, week, or month, the days of the week, and times during which such vehicles may be operated.
C.   Security Or Insurance: To ensure against injuries to the public or property damage, the village administrator shall require the posting of a bond or other security or insurance which he may approve in an amount of not less than twenty five thousand dollars ($25,000.00) running in favor of the village.
D.   Covering Materials Susceptible To Spilling: Whenever such vehicles contain any type of material susceptible to spillage, and blowing of debris or materials therefor, either during the movement, or the loading or unloading thereof, the village administrator may also require that the material being transported be covered in such manner as to prevent such spillage or blowing, or be sprinkled with water or other safe solution, or direct such other preventative measures be implemented to minimize or eliminate such condition from occurring.
E.   Authority To Restrict Use Of Roadways: Whenever it is determined by the village administrator that any roadway under the jurisdiction of the village, by reason of deterioration, rain, snow or other climatic conditions, will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited, or the permissible weights thereon reduced, or other reasonable regulations adhered to, the village may, by ordinance or resolution, direct the village administrator to erect or cause the erection of signs on such roadways for a period not to exceed ninety (90) days in any one calendar year, restricting and regulating vehicular traffic thereon.
F.   Vehicles Excepted From Restrictions: The foregoing weight limitations shall not apply to fire apparatus, equipment used for snow and ice removal operations by the village or any village owned or village operated vehicle. Upon approval of the village administrator, vehicles in excess of such weight limits or in excess of the length limits hereinafter set forth may be allowed on village streets subject to such terms and conditions as may be imposed by said administrator.
G.   Vehicle Length Restriction: No vehicle in excess of fifty five feet (55') in length shall be allowed on any roadway under the jurisdiction of the village except for municipally owned and operated vehicles and fire apparatus equipment used for firefighting purposes.
H.   Posting Signs: The village administrator is hereby authorized and directed to post weight limitation signs at all entrances to village streets and roadways affected by the terms of this section and any other ordinance or resolution enacted pursuant hereto for the restrictions in effect from time to time.
I.   More Restrictive Provisions Govern: Notwithstanding anything contained herein to the contrary, whenever a more restrictive weight or length limitation is imposed by any other governmental body or agency having jurisdiction over a street or roadway located in the village, the more restrictive provisions of such other governmental body or agency shall apply.
J.   Responsibility For Damage To Streets: Any person violating any of the provisions of this section or ordinance or resolution enacted pursuant hereto shall be responsible and liable for any and all damages to village streets and roadways and for all costs and expenses of repair or replacement. This liability shall not relieve any such person from any other penalty provisions of this title that would otherwise be applicable. (Ord. 91-12, 8-26-1991)
