A. Specific Public Nuisances: The following are hereby specifically declared to be a public nuisance:
1. Generally: Any act, occupation, omission, condition, place, thing or use of property that shall:
a. Substantially annoy, injure or endanger the comfort, health or safety of the public; or
b. Render the public insecure in life or in the use of public or private property; or
c. Greatly offend the public morals or decency; or
d. Unlawfully and substantially interfere with, obstruct or render dangerous for passage any street, alley, sidewalk, highway, navigable body of water or other public way.
2. Recreational Vehicle Storage In Residence District:
a. Private Property: Outdoor parking or storage of a recreational vehicle on private property in a residence district for more than five (5) consecutive days, or for more than five (5) days within any thirty (30) day period, unless the recreational vehicle is parked in the rear or side yard of the lot and does not substantially impair the supply of light or air to adjacent properties.
b. Public Property: Outdoor parking or storage of a recreational vehicle on public property in a residence district between the hours of nine o'clock (9:00) P.M. and six o'clock (6:00) A.M.; provided, however, that the owners or occupants of residential lots on which off street storage of recreational vehicles is impossible may park or store a recreational vehicle on the street in front of their lot for a period of not more than five (5) consecutive days, or not more than five (5) days within any thirty (30) day period.
3. Commercial Vehicle Storage In Residence District:
a. Private Property: Outdoor parking or storage of a class I or a class II commercial vehicle on private property in a residence district for more than forty eight (48) consecutive hours, or for more than forty eight (48) hours within any seven (7) day period.
b. Public Property: Outdoor parking or storage of a commercial vehicle on public property in a residence district between the hours of nine o'clock (9:00) P.M. and six o'clock (6:00) A.M.
4. Unlicensed Or Inoperable Vehicles: Outdoor parking or storage of an unlicensed or inoperable vehicle on public or private property in a residence district.
5. Buildings:
a. Uncompleted: Any uncompleted building.
b. Unsafe: Any unsafe building.
6. Weeds, Grass: Unkempt weeds, grass, or plants (other than trees, bushes, flowers, or other ornamental plants or farm or garden crops) with a height in excess of eight inches (8").
7. Diseased Trees: Any "diseased tree", as defined in section 10-11-9 of this code.
8. Garbage, Offensive Substances, Junk, Dismantled Vehicles: The uncovered depositing, dumping, abandoning, accumulating or storing of any offensive substance, trash, garbage, ashes, junk or dismantled vehicle (or parts thereof), offal or carcasses of dead animals or any other miscellaneous waste or refuse. 9. Leaf Blower And Powered Landscape Equipment Operation 1 : The operation of any nonelectric backpack mounted, handheld, or wheel mounted leaf blower ("regulated leaf blower") or any powered (gas or electric) lawn maintenance equipment, including, but not limited to, lawn mowers, trimmers, and tractors, except during the following hours: Monday through Friday: eight o'clock (8:00) A.M. - six o'clock (6:00) P.M., and Saturday/Sunday/holidays: nine o'clock (9:00) A.M. - six o'clock (6:00) P.M.; provided, however, that this limitation shall not apply to the use of:
a. Equipment for the removal of snow, including, without limitation, snowblowers, plows or power shovels; and
b. The use of a regulated leaf blower or other nonelectric power equipment:
(1) For golf course maintenance;
(2) For ordinary public property maintenance activities occurring at least one hundred feet (100') from the lot line of any residence;
(3) For cleanup activities necessary as a result of extreme weather or other emergency conditions as determined and authorized in advance by the village administrator; or
(4) For landscape maintenance activities performed by property owners on their own property between six o'clock (6:00) P.M. and dusk ("exempt maintenance activities").
10. Contagious or Infectious Disease: To intentionally or recklessly engage in any activity that promotes the spread of contagious or infectious diseases throughout the Village, including, without limitation, the intentional or reckless maintenance of unsanitary conditions, intentionally or recklessly hosting gatherings or conducting business in violation of public health orders, and the intentional or reckless failure to maintain or operate properties in compliance with health and safety codes, regulations, ordinances, and orders. This paragraph 10 of subsection 4-1-2 shall run concurrently with the Village President's March 18, 2020, Declaration of Emergency, and shall apply only while such Declaration is in effect.
11. Unscheduled bus stops of intercity buses, in violation of Section 6-8-2 of this Code.
B. Provisions Not Limiting: The identification of the public nuisances identified in this section shall not be construed to exclude other acts, omissions, places, conditions and things from constituting or being identified by the village as public nuisances.
