3-7A-1: DEFINITIONS:
The following definitions shall apply in the interpretation and enforcement of this article:
EMPLOYEE: Any person who shall handle food or drink during preparation, serving or sale, or who comes in contact with eating or cooking utensils, or who is employed in a room in which food or drink is prepared, served or sold.
FOOD DEALER: Includes "restaurant", "itinerant restaurant", "food store" and "itinerant vendor" as defined herein.
FOOD STORE: Grocery store, butcher store, delicatessen store, confectionery store, bakery store, milk store, butter and egg store, fruit and vegetable store, fish store, drugstore, ice cream store, or any combination of the foregoing, or any place where food or drink is prepared, handled, stored, offered for sale or sold at wholesale or retail, and all vending and dispensing machines which contain or dispense such products.
HEALTH OFFICER: The health officer of the village or his authorized representative duly appointed by the health officer by and with the consent and approval of the board of trustees, except as to sections 3-7A-2 and 3-7A-3 of this article where such term shall mean only the duly appointed health officer of the village.
ITINERANT RESTAURANT: A restaurant operating for a temporary period in connection with a fair, carnival, circus, public exhibition or other similar gathering.
ITINERANT VENDOR: Any person traveling from place to place who shall deal in, sell or offer for sale any article of food or drink at wholesale or retail in the village and who does not operate within the village a regular, established store or warehouse for the merchandising of foods, and who does not operate a restaurant or food store.
PERSON: Any individual, partnership, corporation or association.
RESTAURANT: Restaurant, coffee shop, cafeteria, short order cafe, luncheonette, tavern, sandwich stand, soda fountain, school lunch, kitchen, and all other establishments where foods or drinks are sold, as well as kitchens or other places in which foods or drinks are prepared for sale elsewhere.
UTENSILS: Any kitchenware, tableware, glassware, cutlery, utensils, containers or other equipment with which food or drink comes in contact during storage, preparation or serving. (1988 Code § 3-9A-1)
