2-5-3: RULES OF PROCEDURE:
A.   Chair: The chair shall preside at all public hearings and meetings of the PCZBA. In the chair's absence, the vice chair shall perform the functions of the chair.
B.   Secretary; Records:
1.   The village administrator or his designee shall serve as the secretary to the PCZBA. The secretary shall keep minutes of all proceedings, record the vote of each member, the absence or failure to vote of any member and records of hearings and other official actions. In the absence of the secretary of the PCZBA, the village clerk or deputy village clerk shall have the duties of the secretary under this section.
2.   All records of the PCZBA shall be kept in the office of the village clerk and shall be public records.
C.   Minutes: Minutes of the PCZBA will be considered for approval by the PCZBA at the next available meeting after their preparation.
D.   Meetings:
1.   Time And Place: PCZBA meetings shall be held on the third Wednesday in each month commencing at the hour of seven o'clock (7:00) P.M. in the board room, village hall, and at such other times and places as may be called by the chair, and at such other times as the PCZBA shall determine, upon proper notice pursuant to the open meetings act, 5 Illinois Compiled Statutes 120/1 et seq.
2.   Quorum: A quorum of the PCZBA shall consist of four (4) members.
E.   Appeals; Time For Filing: Appeals from orders or decisions based on the zoning regulations may be taken to the PCZBA by any person aggrieved or by any officer or department of the village. Such appeal shall be filed in duplicate with the secretary of the PCZBA within forty five (45) days from the order or decision, and one copy thereof shall be filed with the officer or department whose decision or order is being appealed. The notice of appeal shall specify the particular grounds for the appeal. Upon receipt of the appeal, the officer or department from whom the appeal is taken shall transmit to the PCZBA the record concerning the decision which is being appealed.
F.   Fees: A filing fee as set out in section 1-12-3 of this code, shall be delivered to the village at the time of the filing of the application.
G.   Stay Of Proceedings: An appeal to the PCZBA stays all proceedings concerning the action appealed from, unless the village determines that such stay would cause imminent harm to the public health, safety, or welfare, in which case the proceedings shall not be stayed unless the circuit court enjoins the proceedings.
H.   Hearing On Appeals: Appeals shall be set for hearing within a reasonable time from the date of filing of a notice of appeal, upon due notice being given to the parties, as well as any and all required notice by publication and to property owners within two hundred fifty feet (250') in all directions, excluding public ways, streets, roads, alleys and the like, of the premises at issue. Such hearing may be continued from time to time by direction of the PCZBA. Upon the hearing, any party may appear in person or by agent or by attorney. Within a reasonable time following the completion of hearings, the PCZBA shall complete its consideration of the appeal by reversing, affirming, or modifying, in whole or in part, the order, requirement, decision or determination appealed from, and to that end has all the powers of the officer from whom the appeal is taken.
I.   Procedure At Hearings: The PCZBA may adopt rules of procedure to govern its hearings.
J.   Final Decisions Subject To Review: All final administrative decisions of the PCZBA shall be subject to review under the Illinois administrative review act, 735 Illinois Compiled Statutes 5/3-101 et seq. (Ord. 2012-10, 4-9-2012, eff. 5-1-2012)
